Amnesty International today called on the South Korean government to ensure that striking workers at Ssangyong Motor plant in Pyeongtaek, Gyeonggi province have immediate and unimpeded access to food, water and any necessary medical treatment, and that the police comply with international standards for the conduct of law enforcement officials.

Beginning 16 July, the management at the car assembly plant blocked all food and water from entering the factory, where about 800 laid-off workers have been occupying the paint shop since 22 May. Since 19 July, it has prevented medical personnel from entering the compound. The workers are protesting against the massive lay-off affecting 1,100 workers.

Striking workers have been rationing food as supplies are running low. They also cannot wash or use the toilets. Over the past month, workers have clashed with more than 3,000 riot police and hundreds of private security personnel hired by Ssangyong, resulting in injuries on both sides. Most of the wounded workers and others suffering from chronic medical conditions such as diabetes and high blood pressure have been denied medical attention because management, reportedly with help of police, have stopped medical personnel from entering the building.

Since 19 July, doctors were allowed limited access to the compound on only three occasions – on 22 July, to treat a man shot in the face by a police Taser stun gun, and again on 30 and 31 July. However, there are reports that other strikers are also in need of urgent medical attention as a result of action by the police and private security personnel. In particular, some have reported skin irritation and blisters resulting from contact with liquefied tear gas ejected from a water cannon.

In an apparent attempt to bring an end to the occupation, police helicopters are reported to have been dropping liquefied tear gas during the day and running surveillance throughout the night since 20 July. Through a loud speaker, the management has also been making announcements, calling on striking workers to end the protest and playing loud music day and night.

In no circumstances is it permissible for management or law enforcement officials to attempt to bring an end to a strike by denying the strikers access to essential needs such as food, water or urgent medical treatment. Even if police intervention becomes necessary because strikers¡¯ actions present a substantial risk of violence to persons or serious damage to property, the police must comply with international standards, including the UN Code of Conduct for Law Enforcement Officials, which states that law enforcement officials may use force only when strictly necessary and to the extent required for the performance of their duty. In this regard, Amnesty International is concerned in particular at the police use of electro-shock devices (Tasers). Such weapons are potentially lethal and should be used only where officers are faced with an imminent threat of death or serious injury which cannot be contained by less extreme measures.

ÇØ°í ÀÌÀ¯¸¦ ¶°³ª ¼Ò½Ä¿¡ µû¸£¸é »çÃøÀº 7¿ù 16ÀϺÎÅÍ Æľ÷ÁßÀÎ ³ëµ¿Àڵ鿡 ½ÄÇ° °ø±ÞÀ» ÁߴܽÃÄ×´Ù. »çÃøÀº 7¿ù 20ÀÏ Æľ÷ÁßÀÎ ³ëµ¿ÀÚµéÀÌ ¹üÁËÀÚµéÀ̶ó¸ç ¹üÁËÀڵ鿡°Ô´Â ÀεµÁÖÀÇ´Â ¿Â´çÄ¡ ¾Ê´Ù°í ¸»Çß´Ù. °Ô´Ù°¡ »çÃøÀº ¹°°ú Á¶¸®¿ë °¡½º °ø±ÞÀ» Áß´ÜÇß°í ÀÇ·áÁøµµ °¡·Î ¸·¾Ò´Ù. Æľ÷ÁßÀÎ ³ëµ¿ÀÚÀÇ °¡Á·ÀÌ ½ÄÇ°, ¹°, ´ç´¢¾à µî »ýÇÊÇ°À» Àü´ÞÇÏ·Á°í ÇßÁö¸¸ ÀÌ ¿ª½Ã Çã¶ôÇÏÁö ¾Ê¾Ò´Ù. ÀαÇÈ°µ¿°¡ ¹× ÀÚ¿øÀÇ·áÁøµéÀÌ µé¾î°¡Áö ¸øÇØ µµ¿òÀÌ ÇÊ¿äÇÑ ³ëµ¿Àڵ鿡°Ô ÀÇ·á Áö¿øÀ» ÇÏÁö ¸øÇß´Ù. ¶Ç °æÂûÀº Áö³­ ÁÖ Ç︮ÄßÅ͸¦ µ¿¿øÇØ ³ëµ¿ÀÚµéÀÌ ½Î¿ì°í ÀÖ´Â °÷¿¡ ¹«Â÷º°ÀûÀ¸·Î ÃÖ·ç¾×°ú ÃÖ·ç°¡½º¸¦ »Ñ·È´Ù. ³ëµ¿ÀÚµéÀº ¹°ÀÌ ¾ø¾î¼­µµ °íÅëÀ» °Þ°í ÀÖ´Ù. °æÂûÀº ÇØ»ê°úÁ¤¿¡¼­ Å×ÀÌÀú °ÇÀ» »ç¿ëÇß´Ù. SOUTH KOREA: The AHRC strongly urges the police to allow workers on strike access to basic needs

Ssang Yong Motor Company fired around three thousands workers. The labour union tried to negotiate this matter with the company, but both parties failed to agree. Subsequently, the workers and the labour union occupied the working place and protested against the dismissal. They also demanded that the government and the company take a genuine step to negotiate the situation. Since the occupation, which has lasted for over two months, the government decided to deploy the police force where the workers are striking under the name of prevention of crimes, but in fact, it did not intervene or play a role as an impartial arbitrator.

During this process, two workers and one family member died of mental stress from the dismissal. Another two workers who agreed to voluntarily retire committed suicide. The wife of a labour union leader committed suicide after facing threats and legal action from the company. Meanwhile, the company allegedly instigated other workers who were not dismissed to mobilise to fight against those occupants to take the company back.

Apart from the reasons of dismissal, according to the information received the company stopped providing food to the workers on strike since July 16. On July 20, the company said that the workers on strike are criminals and there is no humanitarian approach to criminals. In addition, it stopped providing water, gas for cooking and prevented medical personnel from providing treatment. The family members of the workers on strike tried to deliver basic necessities such as food, water and medicine for a patient with diabetes mellitus, but were not allowed. Human rights activists and voluntary medical personnel were also prevented entry and so could not provide for those in need of medical assistance. While they held a press conference criticising this prevention, the police arrested them for violation of the Road Traffic Act.

In addition, the police also used helicopters to indiscriminately disperse pepper spray in the location where the workers have been protesting for the last week. The workers also suffer from the absence of water. The police used tazor guns in the process of dispersal. A worker was shot in the face and left behind for three hours without proper medical treatment. According to information received, one patient with diabetes mellitus experienced complications due to the lack of medication provided. It is reported that 200 workers on strike out of around 1,000 wanted to receive medical treatment. Many workers suffered from bruises and fractured ribs.

Like other cases, the police allegedly invited so called 'security guards' who are hired by the company to take part in the operation of dispersal and even allowed them to use violence against the workers with their consent and acquiescence.

Under these circumstances, the Asian Human Rights Commission (AHRC) criticises the unnecessary use of force taken by the police in the process of dispersal and urges the police not to allow the security guards to use violence against the workers, which clearly is contrary to the definition of torture under the UN Convention Against Torture. As far as the workers' health is concerned, the AHRC strongly urges the government to allow the workers access to basic needs such as food, water and medicine so that their health is no longer at risk. We finally urge not only the government, but also all political parties to take genuine steps in providing a place for mediation in order to reach an agreement.
